Welcome to **TUMIA**, an automated reminder service that helps businesses send WhatsApp and SMS reminders to their customers. By using TUMIA, you agree to the following Terms & Conditions.
### 1. Definitions
– **“TUMIA”** means Tumia Automation Limited, the provider of the reminder service.
– **“You / Client / Business”** means the company or individual using TUMIA services.
– **“Customer”** means the person receiving reminders from your business.
### 2. Service Description
TUMIA provides tools for businesses to schedule and send automated reminder messages to their customers. The service may include:
– WhatsApp reminder messages
– SMS reminder messages (depending on plan)
– Tools for scheduling and managing reminders
– Basic customer support
You are responsible for the content of the reminder messages you send to your customers.
### 3. Client Responsibilities
By using TUMIA, you agree that:
– You have your customers’ permission to contact them via WhatsApp and/or SMS.
– You will not use TUMIA to send spam, threats, harassment or illegal content.
– You will comply with all applicable laws and regulations in your country (for example data protection, marketing and communication laws).
– You will keep your account login details safe and confidential.
### 4. Payments & Plans
– Service fees are charged according to the plan you select (for example Basic, Standard or Premium).
– Fees may include a fixed monthly charge and/or usage-based charges (for example number of messages).
– Payments are due in advance for each billing period, unless agreed otherwise.
– TUMIA may update prices from time to time. You will be informed in advance if prices or plans change.
### 5. Service Availability
TUMIA aims to provide a reliable service, but we do not guarantee that the service will be available 100% of the time. The service may be temporarily unavailable due to maintenance, technical issues or reasons beyond our control.
We are not responsible for any losses caused by temporary service interruptions, delayed messages or failed message delivery.
### 6. Data & Privacy
– You remain the owner of the customer data you upload or store in TUMIA.
– We use your data only to provide and improve the service, and to meet legal obligations.
– We take reasonable technical and organisational measures to protect your data.
### 7. Termination
– You may stop using TUMIA at any time.
– TUMIA may suspend or terminate your access if you violate these Terms, abuse the service or use it for illegal activities.
– Some information may need to be retained for legal or accounting reasons even after termination.
### 8. Limitation of Liability
To the maximum extent permitted by law, TUMIA is not liable for:
– Loss of profits, customers or revenue
– Indirect or consequential damages
– Losses caused by your misuse of the service or by not following these Terms
Our total liability in any case is limited to the fees you paid for the service during the last three (3) months.
### 9. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you by email or through the service. By continuing to use TUMIA after the changes take effect, you accept the new Terms.
